As Solicitors acting on your behalf, we collect a certain amount of personal data.

‘Personal Data’ is data relating to a living individual who can be identified from data or from data in conjunction with other information. We will only use your personal data for the purposes set out in this Privacy Notice, this notice explains how, when, and why we process your personal data.

Liberay Legal is regulated by the Solicitors Regulation Authority (SRA) under number 8001151. Our registered office is Atria, Spa Road, Bolton, BL1 4AG, England. Accordingly, we are governed by the SRA’s Codes of Conduct and other professional rules, which you can access on the SRA’s website at www.sra.org.uk.

We are registered with the Information Commissioners Office (ICO) under number ZB296128. We act as the data controller / data processor when processing your data.

Rick Law is the Data Protection Officer for Liberay Legal and his responsibilities include but are not limited to:

• Reviewing Data protection and related policies;
• Advising and training staff on data protection matters;
• Notification to the ICO; and
• Approving contracts with Data Processors

Liberay Legal process your personal information to meet our legal, statutory and contractual obligations and to provide you with our products and services. We will never collect any unnecessary personal data from you and do not process your information in any way other than as specified in this notice.

The personal data we may collect from you is:

• Your date and place of birth;
• Marital status;
• Your home address;
• Your vehicle details;
• Your personal email address;
• Your home and mobile telephone number;
• Your mobile telephone number;
• Your National Insurance number;
• Your Bank account details;
• Your GP details;
• Your current employer details;
• Your job title;
• Your Inland Revenue details.

• Your full medical history;
• Your claims history; and
• Any criminal convictions and CCJs.

Liberay Legal take your privacy very seriously and will never disclose, share, or sell your data without your consent, unless required to do so by law. We only retain your data for as long as is necessary and for the purpose(s) specified in this notice.

Liberay Legal hold, disclose, and process your personal data to provide you with the required legal advice in accordance with our contract and to take steps at your request. This includes using your personal data for:

• Initial discussions;
• Legal advice;
• Progression and settlement of your claim;
• Arrangement of any third-party consultations; and
• Arranging After the Event Insurance policy.
• As detailed in our Terms of Business, we may record and/or monitor calls, emails, SMS messages and other communications for quality control and training, to prevent any unauthorised use of our telecommunications system and website and to prevent or detect crime.

Liberay Legal use several third parties to provide specialist support services and it may be necessary for us to disclose your personal data to these third parties. This is to ensure that our clients receive the best legal advice possible. Examples of the third parties we use include, but are not limited to:

• Barristers / Advocates: We need to use Barristers/Advocates to attend Court hearings and on occasion draft Court documents and provide advice;
• Defendant and the Court: Should Court proceedings be necessary, we will need to share data within the Court proceedings;
• Other third parties including regulatory bodies and law enforcement bodies; and
• Legal, technical support, financial and other professional advisors.
• All third parties acting on our behalf will only process your data in accordance with instructions from us and comply fully with this privacy notice.

Liberay Legal takes your privacy very seriously and takes all reasonable measures to protect and secure your personal data. We have several security measures in place including restricted access, IT authentication, firewalls, and anti-virus.

You have the right to access your personal information that Liberay Legal hold about you. You can request the following:

• What personal data we hold about you;
• The purposes of the processing;
• The categories of personal data concerned;
• The recipients to whom the personal date has/will be disclosed; and
• How long we intend to store your personal data for.
• If you believe that we hold any incomplete or inaccurate data about you, you have the right to ask us to correct and/or complete the information. We will aim to do this as quickly as possible unless there is a valid reason for not doing so, which we will advise you of.

You also have the right to request us to remove your personal data or restrict processing in accordance with the data protection laws; as well as to object to any direct marketing from us.

Liberay Legal only retains personal information for as long as is necessary. We have a legal duty to retain your data for 6 years after the conclusion of your claim, after which time it will be destroyed.

You are not obligated to provide your personal information to us, however as this information is required for us to pursue your claim, we would not be able to act on your behalf without it.
